Terms of Use

1. Who you are contracting with

These Terms of Use ("Terms") form an agreement between you and A Mindless Journey ("we", "us", "our"), the operator of the Mindless Journey app and mindlessjourney.life ("Service"). By creating an account or using the Service, you agree to these Terms.

2. The Service

Mindless Journey is a mental wellness companion offering mood check-ins, journaling, audio guides, and community features. It is not medical advice and is not a substitute for professional diagnosis or care. If you are in crisis, call 911 (US) or 988 (Suicide & Crisis Lifeline).

3. Eligibility & accounts

You must be at least 16 years old to use the Service. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

4. Acceptable use

You agree not to: (a) use the Service unlawfully; (b) commit fraud or send spam; (c) infringe intellectual property or privacy rights of others; (d) upload malware, probe or scrape the Service, or interfere with its security; (e) harass, threaten, or target other members in community features. We may remove content or suspend accounts that violate these rules.

5. Your content

You retain ownership of journal entries, mood notes, community posts, and other content you create. You grant us a limited, non-exclusive licence to host, store, and process your content solely to operate the Service for you.

6. Our intellectual property

The Service — including software, design, audio content we publish, branding, and documentation — is owned by A Mindless Journey or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. You may not copy, resell, reverse engineer, or circumvent any technical limits.

7. Subscriptions, payments & Merchant of Record

Paid features are available through subscription plans (currently Monthly at $9.99/month and Yearly at $79/year). Subscriptions renew automatically at the end of each billing period until canceled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by the Paddle Buyer Terms in addition to these Terms.

You can cancel your subscription at any time from Settings; cancellation takes effect at the end of the current billing period, and you retain access until then. See our Refund Policy.

8. Service level & warranty disclaimer

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is prohibited by law.

10. Suspension & termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time and delete your account from Settings. On termination, sections that by their nature should survive (ownership, disclaimers, liability, governing law) will survive.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction where A Mindless Journey is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local consumer protection law provides otherwise.
